  1. Why is the Closed Landfill Inventory important?
    The CLI is important because it identifies areas of potential environmental risk. Such risk may include explosions from high concentrations of methane gas generated by decomposing garbage, ground and soil contamination.

       

  2. What happens when a closed landfill appears on the Closed Landfill Inventory?

    Only the closed landfills that have exact boundaries or good estimations of boundaries will be deed recorded.

       

  3. Who is responsible for cleaning up sites?

    Current legislation does not address clean-up.

       

  4. What if a closed landfill is identified on a piece of property, but the property owner says a landfill never existed on the property?

    If a property owner disputes the identification of a closed landfill on his property, he may make an appeal to have the information corrected. An appeal requires the property owner to offer proof that the waste was removed or sign an affidavit attesting the property was never used as a landfill. The decision for removal rests with TCEQ.

       

  5. What are the characteristics of sites to be deed recorded?

    Sites to be deed recorded are generally permitted facilities owned or operated by municipalities and/or private companies.

       

  6. How do sites get on the CLI?

    The sites on the CLI by TCEQ were based on data collected from complaints, inspections, permit applications, and permits for facilities that were at least 1/4 acre in size.

       

  7. How can I report a closed landfill?

    Provide TCEQ and the local COG with appropriate information (location, description of site, type of waste).

       

  8. Can AACOG remove sites from the inventory?

    NO. AACOG can recommend removal of a site to TCEQ if adequate proof is presented that the site was never a landfill. TCEQ will make the final decision on removal.


  9. Is the CLI updated regularly?
    The CLI is an ongoing project. Appropriate information on newly known closed sites, or previously unknown sites will be added if it is verified and approved by TCEQ.
