Local Control of Oil and Gas Waste Workshop

Appropriate for peace officers, code enforcement officers, registered sanitarians, prosecutors, elected officials, and other local government staff needing a good understanding of the options available to fight illegal dumping. A special feature of this class will be a presentation by Sam Feagley, Texas A&M University Professor, and State Soil Environmental Specialist, on "Land Application of Drilling Fluids: Landowner Considerations."


This class will cover:
  • State criminal laws that cities and counties can use to control sloppy hauling and illegal dumping of oil and gas waste in their communities. 
  • How your community, the TCEQ, TPWD, and hte Texas Railroad Commission fit together for enforcement.
  • Overview of health nuisance and criminal illegal dumping laws and which laws can and cannot be used to respond to oil and gas waste.
  • Use of municipal ordinances to control pollution by oil and gas waste haulers.
  • Recognizing criminal violations under Natural Resources Code Sec. 91.002
  • Understanding Railroad Commission administrative enforcement of "Statewide Rule 8" and how your community can supplement RRC administrative enforcement.
  • Misdemeanor and felony water pollution (TWC Secs. 7.145 and 7.147)
  • Local civil suits to stop sloppy and illegal hauler activity when all else fails.
Includes six hours code enforcement/RS/TCLEOSE continuing education credits.
